Terms Of Service
Website Development & Upgrade Agreement
Effective March 2025
By submitting a project request through this form, you (“Client”) agree to the following terms and conditions with Expand Your Scope, operated by Drew Evans (“Developer”). These terms are designed to ensure mutual understanding, protect both parties, and define expectations for scope, payment, and delivery.
-
Scope of Work & Agreement
-
By submitting this form, you are requesting an initial assessment and estimate based on the project details provided. A formal proposal with final pricing, timeline, and deliverables will be issued via email.
-
No work will begin until the proposal is accepted in writing and the initial payment is received.
-
All services, features, or deliverables beyond the agreed scope will require a separate written quote and approval.
2. Pricing & Payment
-
All pricing displayed on this site or form is preliminary. Final pricing will be determined in the official proposal.
-
A 50% non-refundable deposit is required to begin work.
-
The remaining 50% is due prior Test Site delivery.
-
Payments are accepted via bank transfer, PayPal, or other methods specified on your invoice.
-
Late payments may result in project delays, suspension, or additional fees.
3. Revision Policy
-
Each package includes up to 3 rounds of revisions, limited to content, image swaps, and layout tweaks.
-
Major structural changes or redesigns are not included in revision rounds.
-
Additional revisions will be billed at $65/hour, or per-round as quoted.
-
All revision requests must be submitted in one consolidated email per round to maintain efficiency.
-
Any requests outside the original project scope will be quoted and approved separately.
4. Timelines & Delivery
-
Delivery timelines are estimates and depend on project complexity and client responsiveness.
-
Delays in content, feedback, or communication may result in rescheduling.
-
If the Client is unresponsive for 14 days, the project may be paused.
-
After 30 days of inactivity, the project may be marked as abandoned and subject to restart fees.
5. Client Responsibilities
-
The client is responsible for providing all necessary content, images, branding materials, and any relevant details required for the website’s completion.
-
If professional content creation (e.g., copywriting, graphic design, or stock image sourcing) is needed, it must be discussed and may incur additional costs.
-
The client is expected to review work at each stage and provide consolidated feedback within a reasonable timeframe to avoid project delays.
-
Expand Your Scope is not responsible for any legal issues related to website content (e.g., copyrighted images, incorrect information, or compliance issues). The client must ensure all provided materials are legally owned or licensed.
6. Cancellation & Refund Policy
-
If the client cancels the project before work has started, a full refund of any deposit paid will be issued.
-
If the client cancels after work has begun, the initial 50% payment is non-refundable, as it covers time, resources, and work already completed.
-
If the project is completed and delivered, no refunds will be issued.
-
If Expand Your Scope needs to cancel the project for any reason, a refund will be issued based on the amount of work completed at that time.
7. Ownership & Rights
-
Upon final payment, the client owns all rights to the completed website design, content, and assets.
-
Until full payment is received, all work remains the intellectual property of Expand Your Scope (Drew Evans).
-
Expand Your Scope reserves the right to showcase the completed website in portfolios, marketing materials, and case studies unless a confidentiality agreement is in place.
8. Website Maintenance & Support
-
After project completion, the client is responsible for ongoing maintenance, updates, and management of the website unless a maintenance package is agreed upon.
-
If support is required after the website has been handed over, additional fees may apply depending on the nature of the request.
-
Expand Your Scope is not responsible for third-party updates, hosting failures, security breaches, or software conflicts that occur after delivery.
9. SEO & Structured Data Implementation
-
Basic SEO setup includes meta tag descriptions, social share settings, and structured markup implementation to help Google and other search engines properly read and index the site’s content.
-
SEO work does not guarantee immediate or specific ranking results, as search engine algorithms are dynamic and dependent on various external factors.
-
If advanced SEO services (such as in-depth keyword research, backlink building, or content marketing) are required, they will be quoted separately.
10. Acceptance & Agreement
-
By checking the box in the form and submitting it to ExpandYourScope, you acknowledge that you have read, understood, and agree to these terms and conditions.
